These general contractual
conditions are intended to establish the terms and conditions which shall be
guidelines of all travel services provided by Ajsa Tours,Unipessoal, Lda, with
its headquarters located at Rua Amélia Rey Colaço, 3, r/c dtº, 2955-003 Pinhal
Novo - PORTUGAL, with a business equity of 1,000, VAT
number 509 943 489. The company operates in cultural-historical tourism,
creating products that contribute to the development and dissemination of
cultural heritage, both tangible and intangible history of Portugal.
Privacy Policy
0.1. This site is property of by Ajsa Tours. Whilst using
the site or its information, data archives, texts, graphics, links, audio,
photos, vídeos ou other images, resources and services available through the
site, the user, either as a participant or visitor, agrees with the terms of
use, privacy policy and info protection in the paragraph 1.2.
0.2. In agreement with the Portuguese law - Protection of
Personal Data Act 67/98 - we inform you that the data provided in this website
is public and shareable with other third ones. If wish to present this on

unlawful purposes or any other purposes that might be considered prejudicial to

counterfeit and legitimate identification beyond unfair competition, are crimes

1. Tours
1.1. The various tours presented in this
website are copyrighted products prepared by the company. They are operated by
a Tour Guide speaking fluently the customers language.
1.2. Ajsa Tours are operated in
different vehicles depending on the number of people: Up to 6 people in Vans.
Between 7-14 people on mini- bus. More than 15 people in tourism buses hired by
the company.
1.3. Buying a day tour or a tour
package (private or in group) ensures the customer transportation, guide
service throughout the day and throughout the trip, admission tickets to
monuments when mentioned, tasting of traditional sweets when mentioned, wine
tasting when mentioned, accommodation and meals at quality hotels or family
traditional accommodation from 3-5 stars, insurance coverage in accordance to
Portuguese law. Any extra is not included in the tour and will be the
responsibility of the customer. Any changes will be according to customers demands.
1.4. Some monuments are closed on
certain days of the week. The company avoids these days by creating exceptions. However, the monuments may close
without prior notice or on national closure days like Easter holidays, January
1st, May 1st and December
25th, so the company cannot guarantee visit at these days.
2. Reservations and Payments
2.1. In order to confirm a reservation
of a multi-day tour package the client must deposit 20% of the full price, settling
the remaining 80% in cash(only EURO) at the beginning of the tour.
Should any further reservations
such as hotels or tourbuses have to be made in advance, a pre-payment may be
required.
2.2. The Ajsa Tours Ltd reserves the
right to cancel any reservation for which payment has not been effected under
the above conditions.
2.3. Price changes in packages: The
budget sent to our customers expire after 14 days. After that period, prices
may increase due to several changes according to availability of the hotel
partner, transportation partners, tour guides, and other services included in
the packages.
2.4. Payments can be processed by one
of the following methods:
2.4.1. Bank Wire Transfer(upon request):
Necessary to send bank receipt.
2.4.2. PayPal: PayPal presents itself as
an international payment service of trust, solidity and fast operations. It is
very easy to use it, one just need to have a credit card, and insert the data
when you are sent an invoice. It is NOT necessary to
be a registered user.
2.4.3. Visa
2.4.4. Mastercard
3. VAT
3.1. Quoted prices already reflect the value added tax (
VAT ) at the current rate. This fee is mandatory in EU countries and where the
service is operated.
4. Cancellations, NO-SHOW and
Changes
4.1. The customer may cancel the trip
at any time, however, should be aware that the amount paid to date may not be
partially or entirely refunded. Please check the refund policy - Point 8.
4.2. In case of NO-SHOW (no show at
the date of arrival), the agency will not make any refund concerning the trip
of the absent customer. Applies to hotels, restaurants, entrance fees to
monuments, etc.
4.3. If the client prefers, and if
possible to the travel agency, changes can be made to departure dates, hotels,
room type, vehicle transportation, selected restaurants and places to visit,
with at least 7 week days in advance.
4.4. Customers may also reallocate
their participation and payment with a substitute person who satisfies all the
conditions required for the trip, provided of notification to the agency at
least 3 days in advance and acceptance of service providers included in the
trip.
4.5. Whenever there are sufficient
reasons, the agency may change the order of the itinerary or services provided,
like hours of departure or replace any hotel initially planned by others of
similar category. If unforeseen circumstances force the agency to suspend any
trips or a car failure happens, customers will be entitled to reimbursement of the amounts already paid but not entitled to further compensations.
5. Luggage Responsibility
5.1. The Agency only takes
responsibility for any damage or loss of luggage in multi-day tour packages
(land transportation) when luggage has been kept in the car trunk/boot. As it
is considered to be the most appropriate place to ensure the safety of the most
precious and important items of our customers, and not visible to the outside.
5.2. When luggage is kept inside the
hotel room, it is at the customers responsibility. One should keep its belongings in a safe place and locked if
possible.
5.3. Under no circumstances is the
agency will be responsible for the loss or theft of valuable items such as
gold, diamonds, jewelry, silver and money, personal documents, credit cards,
notary documents, projects, paintings or art manuscripts.
6. Insurance
6.1. As required by law, Article 35 of Decree-Law n º
199/2012 of 24 August, trips made by Ajsa Tours Ltd are covered by liability
insurance.
6.2. The minimum amount covered by insurance is 75,000 EUR,
covering the risks arising from the activity, guaranteed compensation for
damage to property and injuries caused to customers or third parties for actions
or omissions of Ajsa Tours or their representatives.
6.3. The insurance also covers:
6.3.1. The repatriation of customers and their assistance.
6.3.2. The medical care and necessary medications in case of
accident or illness occurring during the trip, including those which are
necessary after the completion of travel.
7. Documentation
7.1. Clients should always have with them updated personal
documentation (passport, permits, updated vaccines, documentation regarding
dietary restrictions, etc.).
7.2. Under no circumstances the agency will be held
responsible for the loss or theft of our customers personal
documents such as passport, driving license, ID cards and bank debit or credit
cards.
8. Refunds
8.1. Private tours (1 day), if
cancelled the refund policy is the
following:
8.1.1
More than 5 days before arrival: 100% refund.
8.1.2
Between 5 and 1 days before arrival: 50% refund.
8.1.3 Less than 24hrs or No
Show: No refund.
8.1.4 Cancellation or No Show due to “*Acts of God”:
100% refund.
*Act of God
An event that directly and exclusively results from the occurrence of natural causes that could not have
been prevented by the exercise offoresight or caution; an inevitable accident.
Courts have recognized various events as acts of God—tornadoes, earthquakes, death, extraordinarily high tides, violent winds, and floods.
The client or his/her legal representant has to
deliver to the agency a proof of the occured fact.
8.2. Tour Packages (over 1 day), if
cancelled the refund policy is set out below:
8.2.1
More than 15 days before arrival: 100% refund.
8.2.2
Between 15 and 8 days before arrival: 50% refund.
8.2.3 Less than 8 days or No
Show: No refund.
8.2.4 Cancellation
fees may apply to hotel reservations and external service providers.
9. Complaints
9.1. Clients reserve the right to complain for the services
provided or any other aspect that has gone against the quality of service.
These complaints shall only be considered when submitted in writing to the
agency where the booking and payment was made, within no more than 10 days
after the end of the services. Complaints may be written to our head office:

9.2. Likewise, we only accept complaints that have been
communicated to the respective suppliers (hotels, guides, local, etc.) during
the course of the journey or stay, requiring the legal complaints book for this
purpose.
